DMCA (Digital Millennium Copyright Act) und der Abgasbetrug, wie gehoert das zusammen?
Nun, die Steuersoftware auf den zahlreichen ECUs von modernen Fahrzeugen koennen solche Tricks verraten. Aber nicht mehr, wenn man unabhaengige Dritte daran hindert, die Software zu analysieren. Da viele Experten trotzdem technisch dazu in der Lage sind, kann man es immer noch per Gesetz unter Strafandrohung versuchen zu unterbinden. Jedem der solche Praktiken per Software-Analyse beweisen koennte, drohte eine mehrjaehrige Haftstrafe.
Some background: Section 1201, the anti-circumvention provision of the DMCA, was created, supposedly, to help discourage people from breaking DRM restrictions in order to infringe, but in practice it has chilled a wide array of legitimate activities that require users to break DRM in order to do completely legitimate, non-infringing things that were often never even contemplated by device designers and rightsholders. But once every three years, the Librarian of Congress, working with the Copyright Office, hears requests from the many members of the public whose speech and other rights are chilled by the law and considers whether to grant exemptions.

Modern cars contain dozens of computers called electronic control units (ECUs), and the code on those ECUs is potentially covered by copyright. But many repairs require access to that code, as does research into vehicle safety. When auto manufacturers deploy technology to lock people out of the code controlling their own cars, that can transform an act of repair or research into a violation of the DMCA. The result is that only persons authorized by the manufacturer can effectively perform repairs, and independent audits of car safety and security take place under a legal cloud, if at all.

Es gibt beim DMCA Ausnahmen, z.B. fuer Forschungseinrichtungen, aber genau die wollen die Autohersteller incl. Volkswagen verhindern.

We’ve asked the Librarian of Congress to grant an exemption to the DMCA to make it crystal clear that independent research on vehicle software doesn’t violate copyright law. In opposing this request, manufacturers asserted that individuals would violate emissions laws if they had access to the code.

The Alliance of Automobile Manufacturers, an advocacy group that represents most of the world’s major automakers, including Volkswagen, opposed the DMCA exemption (.pdf), arguing it would create or exacerbate “serious threats to safety and security.â€
